Warranty disclaimer. BK9Hoopers will provide the BK9Hoopers Service using reasonable care and skill and in accordance with any specification of the BK9Hoopers Service provided by BK9Hoopers, however, subject to that, the BK9Hoopers Service is provided “as is'” and “as available”, without any warranties of any kind, whether express, implied, or statutory. BK9Hoopers makes no representation regarding, nor does it warrant or assume any responsibility for, any third-party applications (or the content thereof), user content, devices or any product or service advertised, promoted or offered by a third party on or through the BK9Hoopers Service or any hyperlinked website, and BK9Hoopers is not responsible for any transactions between you and any third-party providers of the foregoing. No advice or information whether oral or in writing obtained by you from BK9Hoopers shall create any warranty on behalf of BK9Hoopers.
Limitation of Liability. Subject to applicable law, you agree that your sole and exclusive remedy for any problems or dissatisfaction with the BK9Hoopers Service is to stop using the BK9Hoopers Service. In no event will BK9Hoopers, its officers, shareholders, employees, agents, directors, affiliates, suppliers, or contractors be liable for (1) any indirect, special, incidental, punitive, exemplary, or consequential damages; (2) any loss of use, data, business, or profits (whether direct or indirect), in all cases arising out of the use of or inability to use the BK9Hoopers Service, devices, third-party applications, or third-party application content; or (3) aggregate liability for all claims relating to the BK9Hoopers Service, third-party applications, or third-party application content more than the greater of (a) the amounts paid by you to BK9Hoopers during the twelve months prior to the first claim; or (b) £10.00. Any liability we do have for losses you suffer is strictly limited to losses that were reasonably foreseeable.
Indemnification. You agree to indemnify and hold BK9Hoopers harmless from and against any reasonably foreseeable direct losses, damages, and reasonable expenses (including reasonable attorney fees and costs) suffered or incurred by BK9Hoopers arising out of or related to: (1) your breach of any of these Terms; (2) any activity in which you engage on or through the BK9Hoopers Service; and (3) your violation of any law or the rights of a third party. Changes. BK9Hoopers reserves the right to update or change the Terms or prices at any time.
Termination. You may terminate this Agreement at any time by deleting your Account. BK9Hoopers may terminate this Agreement at any time on prior notice. Should you violate these Terms, threaten the operation of the Service, or act in a way unbecoming of the BK9Hoopers ethos, BK9Hoopers may delete your Account and terminate this Agreement with you unilaterally without prior notice.
